A Federal judge in Texas has handed Barack Obamas executive amnesty scheme another defeat, refusing to lift his stay blocking Obamas effort to hand unlawful amnesty to millions of illegal aliens.
The tough ruling by a clearly angry judge was described as a a scathing rebuke to Obamas lawyers for misleading him.
In a unexpected, late night Tuesday ruling, U.S. District Judge Andrew Hanen sided with the State of Texas and 25 other states that are suing to stop the executive action that would grant legal status to at least 5 million illegal aliens.
Hanens move, if not reversed by a higher court, could delay any further amnesty actions until Obama leaves office a huge blow to the Democrats efforts to get illegal aliens to the voting booth by 2016.
The states have sued the federal government claiming that Obamas amnesty would cause irreparable harm and financial loss to their state if the executive action continues. Earlier this year Hanen granted an injunction requested by the 26 states seeking to halt the implementation of Obamas amnesty. They states claimed the damage would have already been caused and even if they won the lawsuit there would be little they could to at that point.
Hanen not only refused to lift his order, he also issued what The Washington Examiner called a scathing rebuke to Obamas lawyers for misleading him.
In fact, says the Examiner report by Byron York, the angry judge came very near to accusing administration lawyers of flat-out lying to him.
The administrations assertions in the immigration case have been misleading, troublesome, and belied by the facts, Hanen wrote. Any number of federal judges, given this misconduct, would consider striking the governments pleadings.
Doing so would effectively end the case altogether, and Hanen wrote that he had decided not to take that action because the issues at stake are of great national importance.
Hanens anger is apparent throughout the order. One government assertion is belied by the facts. A government explanation is troublesome. Omissions from the governments filings are mysterious.
The Washington Examiner article notes that Judge Hanen even went so far as to characterize the actions and assertions of Obamas legal team as fabrications, misstatements, half-truths, artful omissions….
So, for now, the presidents executive amnesty orders remain blocked by Judge Hanens preliminary injunction. On April 17th, the Fifth Circuit Court of Appeals is scheduled to hear arguments about lifting that injunction.
Hanens new ruling comes after Obamas DOJ tried to fight the judges ruling by asking for a stay of the injunction, and also after exposure of a stunning violation by the Obama Administration by granting a three year extension to the program known as DACA which granted status to hundreds of thousands of illegal aliens in school.
The judge could also cancel more than 100,000 deportation deferrals of illegal aliens which Obama attorneys lied to the judge to conceal and order radical changes to the way Obamas DHS handles future immigration cases.
In the ruling (below), it is quite clear and unequivocal in stating that Obama is not only in violation of the Immigration and Naturalization Act, but he is making his lawlessness mandatory on other government agencies.
